Austin police Sunday night, released the driver who shot Foster at a Black Lives Matter riot in downtown Austin Saturday.
Foster who was carrying an AK-47-style rifle was at the protest with his quadruple amputee fiancée, Whitney Mitchell, 28.
At about 10 p.m. Saturday, a car reportedly turned down the street toward the protesters and the driver started honking its horn.
The vehicle stopped as rioters began striking the car in the roadway, police said. Foster approached pointing his weapon by the driver’s side window. Then shots rang out. The driver opened fire, striking Foster. Someone else in the crowd did return fire as the car left the scene.
The driver and the other person who shot were released from policy custody after they gave their accounts of what happened. Police is asking for help from the public “to determine the precise actions of those involved.”
Both of them had a license to carry a handgun. It was not clear whether Foster had a such a license, but it is legal in Texas to openly carry a rifle like an AK-47 without a license.
Hiram Gilberto, a journalist who took video of much of the protest, filmed Foster earlier in the night with the gun. “They don’t let us march in the streets anymore, so I got to practice some of our rights,” Foster said on the video. “If I use it against the cops, I’m dead.”
Patricia Kirven, Mitchell’s mother, was driving from Plano to Austin to be with her daughter when The News reached her Sunday afternoon. “I told her not to go. I was afraid something would happen,” Kirven said. “She said, ‘I don’t feel like I’m doing enough. I want to do more.‘"

BLM rioters have destroyed city blocks and businesses, and attacked innocent people.
In Portland and Seattle, far left antifa and BLM rioters have been attacking federal law enforcement agents and local police officers. They set fires to government buildings and dox law enforcement agents putting the agents' families at risk.
These far left extremists commit these atrocities without any attempt by their democrat Mayors and governors to step in and stop the carnage. Instead they attack President Trump when he offered to help.
The President announced Wednesday that he is sending additional 100 federal agents to Chicago to combat rising gun violence in the City.
